Acceptable Use Policy

Version 2.0 · Effective November 3, 2026

This Acceptable Use Policy (“AUP”) is part of the Agreement between AMP Catalyst LLC, doing business as “Imba” (“Imba”, “we”), and each Customer. It applies to everyone who uses the Service, including Customers, Authorized Users, and Builders, and to every App, bot, message, and piece of content created or distributed with the Service. Capitalized terms have the meanings given in the Terms of Service.

The basic rule: you may not use Imba to do anything that is illegal, harmful, deceptive, or that infringes the rights of others — anywhere your App is available or your End Users are located. The lists below are examples, not an exhaustive catalogue.

1. Illegal activity

You must not use the Service to:

  • (a) violate any applicable law or regulation in any jurisdiction where your App is available or your End Users are located;
  • (b) promote, facilitate, or carry out any illegal activity;
  • (c) violate sanctions or export-control laws, or provide products or services to sanctioned persons or territories.

2. Prohibited Apps and content

You must not create, publish, or distribute Apps or content that involves:

2.1 Gambling and real-money gaming

  • casinos, betting, sweepstakes, lotteries, or any game of chance or skill where End Users pay or stake money, Telegram Stars, cryptocurrency, or anything of value for a chance to win something of value;
  • selling Coins, awarding Coins for any payment, or limiting Coin-earning competitions to paying End Users — see Terms of Service, Part B, Module 2;
  • prediction games or prize wheels that function as betting or gambling, or that are unlawful where your App is available;
  • prize promotions run without the permits, registrations, or official rules required by local law.

2.2 Financial harm and fraud

  • pyramid schemes, Ponzi schemes, multi-level marketing with recruitment-based rewards, or “get rich quick” schemes;
  • unlicensed financial services, investment advice, trading signals, or deposit-taking;
  • offering, promoting, or trading cryptocurrencies, tokens, or other crypto-assets in breach of applicable law;
  • phishing, scams, fake giveaways, fake prizes, or collecting payment or credentials under false pretenses;
  • impersonation of any person, brand, government body, or of Imba or Telegram.

2.3 Regulated and dangerous goods

  • weapons, ammunition, explosives, and their components;
  • illegal drugs, controlled substances, drug paraphernalia, and prescription medicines without required authorization;
  • tobacco, vaping, alcohol, or cannabis products where sale or promotion is prohibited, or without required age verification;
  • counterfeit, stolen, or recalled goods;
  • any other goods or services whose sale or promotion is prohibited where your App is available.

2.4 Adult and harmful content

  • sexually explicit content, pornography, or sexual services;
  • any content that sexualizes, exploits, or endangers minors — this results in immediate termination and reporting to the competent authorities;
  • content promoting self-harm, suicide, or eating disorders;
  • graphic violence, terrorism, violent extremism, or content supporting designated terrorist organizations;
  • hate speech, harassment, threats, or incitement against any person or group.

2.5 Deceptive practices

  • false or misleading claims about products, services, prices, prizes, odds, or results;
  • fake reviews, testimonials, or engagement;
  • partner tasks or sponsored content not labelled as advertising where the law requires it;
  • health claims prohibited by law, or contradicting established public health guidance;
  • content designed to manipulate elections or civic processes.

2.6 Intellectual property and privacy

  • content that infringes copyright, trademark, or other rights, including embedded videos or streams you have no right to show;
  • publishing personal data of others without a lawful basis;
  • collecting sensitive personal data (health, biometric, government ID numbers, full payment card data) unless expressly permitted in an Order Form.

3. Messaging and push notifications

You must not:

  • (a) send marketing or promotional messages without the consent required by applicable law;
  • (b) send spam, unsolicited bulk messages, or messages with misleading sender information or content;
  • (c) ignore or obstruct End Users’ requests to stop receiving messages;
  • (d) send messages that violate Telegram’s terms or policies;
  • (e) use the Service to message individuals who have not interacted with your bot or App.

4. Game mechanics, referrals, and Coins

You must not:

  • (a) make participation in any Game Mechanic involving Prizes conditional on a purchase or payment;
  • (b) give Coins a cash, resale, or exchange value;
  • (c) misrepresent odds, prizes, leaderboard criteria, or the conditions for winning;
  • (d) fail to award or deliver Prizes you have promised;
  • (e) artificially inflate referrals, activity, leaderboard positions, or metrics using bots, fake accounts, or other manipulation;
  • (f) offer Game Mechanics to minors where this is prohibited, or offer Prizes without the eligibility rules required by law.

5. Abuse of the Service

You must not:

  • (a) attempt to gain unauthorized access to the Service, other accounts, or Imba’s systems;
  • (b) probe, scan, or test vulnerabilities, or perform load or penetration testing, without Imba’s prior written consent;
  • (c) upload or distribute malware or harmful code, including through Custom Code or embedded pages;
  • (d) use Apps, links, or redirects to send End Users to malicious, deceptive, or prohibited destinations;
  • (e) place an unreasonable load on the Service, or interfere with its operation or other users;
  • (f) scrape the Service or use automated access outside documented interfaces;
  • (g) circumvent plan limits, MAU limits, Credit limits, Transaction Fees, or Imba branding;
  • (h) create multiple accounts or abuse free plans, trials, or promotions to evade limits, fees, or enforcement;
  • (i) reverse engineer the Service, its prompts, models, or datasets;
  • (j) resell or sublicense the Service except as permitted in the Terms of Service.

6. AI Features

You must not use AI Features to:

  • (a) generate content that violates this AUP or applicable law;
  • (b) create deceptive deepfakes or impersonations of real people;
  • (c) mislead people into believing AI-generated content is human-made where disclosure is required by law;
  • (d) submit Inputs containing sensitive personal data, or data you have no right to use;
  • (e) extract prompts, model behavior, or outputs to build competing AI models or datasets;
  • (f) attempt to bypass safety controls (“jailbreaking”).

7. Your End Users and children

  • You are responsible for ensuring that your App, its content, and its Game Mechanics are appropriate for its audience.
  • Apps directed at children must comply with all applicable child-protection and children’s privacy laws. You must not collect personal data from children without the consents required by law.

8. Enforcement

8.1 How we monitor. Imba does not pre-approve Apps and does not routinely review content. We act on reports, on signals from automated abuse detection, on requests from authorities or Telegram, and where we otherwise become aware of a potential violation.

8.2 What we may do. If we reasonably believe that an App, content, account, or activity violates this AUP, the Agreement, or applicable law, we may, at our discretion and in proportion to the violation:

  • issue a warning and request a fix;
  • remove or disable specific content, Custom Code, or features;
  • restrict or geo-block Game Mechanics, Coins, messaging, or payments for an App;
  • unpublish an App;
  • suspend or terminate the account;
  • preserve information and report illegal content to competent authorities where required or appropriate.

8.3 Immediate action. We may act without prior notice in cases involving child sexual abuse material, imminent harm, fraud, malware, legal orders, or serious risk to Imba, End Users, or third parties.

8.4 Statement of reasons. Where we restrict content or an account, we will notify the affected Customer and give the main reasons, unless we are legally prohibited from doing so or notice would undermine the purpose of the action.

8.5 Your liability. You are responsible for any damages, fines, or costs that Imba incurs because of your violation of this AUP (see Terms of Service, Section 19).

9. Reporting a violation

Anyone — including End Users — can report an App, content, or behavior that may violate this AUP or the law, by email to [email protected].

Please include the App or bot name or link, a description of the issue, the reason you believe it is illegal or violates this AUP, and your contact details.

European Union and United Kingdom. Reports about illegal content may constitute notices under Article 16 of the EU Digital Services Act or illegal-content reports under the UK Online Safety Act. We will process them in a timely, diligent, and objective manner and inform the reporter of our decision.

10. Copyright and trademark complaints

10.1 How to complain. If you believe content in an App infringes your copyright or trademark, send a notice to our designated agent at [email protected] or AMP Catalyst LLC, Attn: Copyright Agent, 108 W. 13th Street, Suite 100, Wilmington, DE 19801, USA. The notice must include:

  • identification of the protected work or trademark;
  • identification of the infringing material and its location (the App or bot name and link);
  • your contact details;
  • a statement that you have a good-faith belief that the use is not authorized by the owner, its agent, or the law;
  • a statement, under penalty of perjury, that the information in the notice is accurate and that you are the owner or authorized to act for the owner;
  • your physical or electronic signature.

10.2 Counter-notice. If your content was removed and you believe this was a mistake or misidentification, you may send a counter-notice to the same address, identifying the removed material and its location, stating under penalty of perjury that you have a good-faith belief it was removed by mistake, and consenting to the jurisdiction of the competent court.

10.3 Repeat infringers. We will terminate, in appropriate circumstances, the accounts of Customers who repeatedly infringe the rights of others.

10.4 False notices. Knowingly submitting a false notice or counter-notice may create liability for damages.

11. Appeals

If you disagree with a decision we have made about your App, content, or account, you may appeal within 6 months of being notified by emailing [email protected] from your account email, explaining why you believe the decision should be reversed. A person who was not involved in the original decision will review the appeal, and we will inform you of the outcome. This does not affect any right you have to seek remedies before courts or other bodies.

12. Changes

We may update this AUP to respond to new risks, laws, or features. The current version is always available on our website. Material changes will be notified in accordance with the Terms of Service.
